The Meghalaya State Electricity Regulatory Commission (MSERC), on May 18, 2026, issued a pre-publication notification proposing the Meghalaya State Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff for Generation from Renewable Energy Sources) (First Amendment) Regulations, 2025. The draft amendment seeks to strengthen the regulatory framework governing renewable energy (RE) projects in the State and will come into force upon publication in the Official Gazette.
The proposed amendments introduce new provisions relating to the sale of power by RE-based generating stations. Renewable energy generators would be permitted to sell electricity to distribution licensees at Commission-determined tariffs, to eligible open access consumers, or to buyers within or outside Meghalaya at mutually agreed rates, subject to applicable laws and policies. The draft also requires prior Commission approval of power purchase agreements (PPAs) before execution and provides for PPAs to remain valid for the entire tariff period.
Further, the amendment proposes a comprehensive framework for open access in both transmission and distribution systems. RE generators would be entitled to non-discriminatory open access for captive use and third-party sale, subject to payment of applicable charges, adjustment of losses, and availability of network capacity. The Commission would also be empowered to adjudicate disputes regarding surplus transmission or distribution capacity.
